The Private Housing (Tenancies)( Scotland) Act 2016 which takes effect from 1 December 2017 will introduce a new model tenancy called Private Residential Tenancy. The key aim of Private Residential Model is to provide security, stability and predictability for tenants and appropriate safeguards for landlords, lenders and investors.
The Private Residential Tenancy will be
- an open-ended tenancy with no fixed term periods (short assured was minimum 6mths)
- no pre-tenancy notices, such as the AT5
- one simple notice when regaining possession of a property called a
‘notice to leave’ – this will replace the current ‘notice to quit’ and
‘notice of proceedings’ - provide comprehensive and robust grounds for repossession that will
allow landlords to regain possession in 18 specified circumstances
All existing short assured tenancies created prior to 1 December 2017 will continue beyond this date until either the tenant or landlord ends the lease. All new tenancies from 1 December 2017 will be private residential tenancies.
